Amendment IX
The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people. This provision gives the American people the right to claim any and all prerogatives which belong to them, whether or not they are enumerated in this Constitution. One of the reasons the framers of the Constitution did not want to enumerate a Bill of Rights was that they feared that the enumeration would never be complete and that other rights might therefore be lost because they were not included. This provision was designed to be a catch-all clause to protect all other rights which had not been enumerated.
Amendment X
The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people. This provision gives the states and the American people the Right to retain all powers not delegated to the federal government, and which are not prohibited by the Constitution to be exercised by the states.
